Terms and Conditions Group Classes

 

The term ‘Piece of Music’ or ‘us’ or ‘we’ refers to the company whose Registered Office is 11 High Street, Hampton Wick, Kingston-upon-Thames, KT1 4DA. Our company registration number is 14118657, Registered in England and Wales. The term ‘you’ refers to the parent/carer of students participating in our classes.

 

Participation in Piece of Music Classes.
 

Mission Statement
 

Our aim is to provide and fun and interactive class to preschool children which encompasses original songs, memory, language and coordination skills in an exciting, enjoyable and multi-sensory way.

 

Weekly Classes

    •    Carers are responsible for their children at all times. Our classes are run without carers present, but carers are asked to stay in the vicinity of the venue.

    •    The teacher must be informed of any relevant health issues before the start of a class.

    •    Please be aware that classes must run to a tight schedule so must begin promptly at the set time. There is only a short changeover time between classes, so please note that there may be other children entering the room as you get ready to leave.

    •    If a class must be cancelled for any reason, the teacher will give as much notice as possible. A message will be sent by text to inform all customers. If a mobile number has not been given an email will be sent. Unfortunately, Piece of Music cannot reimburse any expenses caused by a customer failing to pick up their message.

    •    Please note that photos and videos might be taken occasionally during our classes and published on our site, social media and in marketing materials. If you do not wish for your child to appear in the photos, kindly inform us by sending an e-mail to info@pieceofmusic.co.uk, stating the name and surname of your child and the location of the class. At any given time you also have a right to request us to remove the photos of your child from our site, social media or marketing materials. 

    •    If your child is unable to attend a class please inform Piece of Music via email or text.

    •    Lost property will be picked up by the teacher. Every effort will be made to reunite the item with its owner. If unclaimed by the end of term the item may be disposed of.

 

Changing Class Times and Venues 
 

- If a class becomes too small to run we may need to merge it with another. We do our best to keep class times as similar as possible but unfortunately cannot always guarantee this.

- If it is not possible to merge a class it may need to be cancelled. 

- If a class becomes full we will open a waiting list and always try to open another class to cope with demand.
 

Should you need to change class times we will do our utmost to accommodate you, but unfortunately cannot guarantee it. 

To secure your place in a class at Piece of Music you must book your place online.

 

Fees/ Refunds/ Notice Period

    •    Fees are payable in advance.

    •    In the event of a lesson being cancelled by a teacher, the fee will be discounted from the following term.

    •    If a lesson is cancelled part way through, customers will only be credited if they were in attendance.

    •    In the event of a child being unable to attend a class due to illness or a holiday, we regret that we are unable to refund payment as this secures an ongoing place on our programme.

 

Staff Qualifications

    •    All teachers have a current DBS.

    •    Due to the educational nature of the Piece of Music programme all staff have a background in music. Please ask your teacher if you would like to know more about their musical/teaching background, or have a look at our website for information.

    •    A potential new teacher may be trained by the business owner during classes. As part of their training, a new teacher may run part or all of a class but always under the supervision of an experienced and qualified teacher.

 

Child Protection
 

Piece of Music believes that the safeguarding of children is a serious matter. Given the nature of our work it is highly unlikely that any member of staff would have direct and unsupervised contact with a child, but we recognise our responsibility for promoting best practice.   

 

If there is any suspicion that a child may be in harm, action will be taken by teacher to report this to authorities.  Also if parents/carers also have concerns this can be discussed with the teacher or you can contact the authorities in your own right.

Covid-19 Considerations
 

By attending live, face to face sessions you agree that:

    •    You will not attend class if you or anyone in your household displays symptoms of Covid-19;

    •    You will observe all instructions with regards to social distancing and infection control procedures as directed by your class leader and venue management team;

    •    You acknowledge that procedures are subject to change at any time.
 

Changes to our terms and conditions
 

We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable these changes will be communicated to all our customers by email. If you use our website after the new Terms and Conditions have come into effect this indicates your agreement to be bound by them.
 

Disclaimer

Piece of Music Ltd, it’s teachers, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent/Carer, the child or any other party arising directly or indirectly or in any way connected with the attendance of the child at the sessions including but not limited to, the unavailability of a teacher, ‘Acts of God’, the postponement or delay in the Course (or any part of it) or any other act or omission on the part of Piece of Music Ltd or any of its teachers, employees or agents.

By attending any Piece of Music class, party or event you agree to constantly supervise all the children in your care and to take full responsibility for them.
 

Piece of Music have taken all reasonable care in ensuring that their programmes are safe. However, the Parent and/or Carer agrees that their child will be engaging in physical activities that may involve some risk of injury. The Parent and/or Carer acknowledges that they have been advised to consult with their child’s physician with respect to any past or present injury, illness, health problem or any other condition or medication that may affect their child’s participation in Piece of Music classes.
 

The Parent and/or Carer assumes the above risks and accepts responsibility for any injury sustained by their child and agrees to discharge and hold harmless Piece of Music Ltd, its Owners,  and personnel including its Teachers and its Suppliers from any liability arising from any injury to your child or other persons or property caused by your child’s participation in the Piece of Music programmes.

Piece of Music takes no responsibility whatsoever for any loss, damage or expense incurred by a Pupil and or Parent/Carer whilst participating in a class or whilst on the premises of where a class is taking place.

By participating in our classes you agree that refunds will not be issued due to sickness, holiday leave, ‘Acts Of God’ or ‘Force Majeure’.

Piece of Music reserves the right to exclude a Parent and/or Carer and/or Pupil from a class permanently, or for the time they feel necessary, due to behaviour that is not deemed acceptable within a class.

The Parent and/or Carer agrees that any claim made against Piece of Music Ltd, its Owners, and personnel including its Teachers and its Suppliers, will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim.

 

Limitation of liability
 

Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.
 

To the maximum extent permitted by law, Piece of Music Ltd accepts no liability for any of the following:
 

    1.    Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

    2.    Loss or corruption of any data, database or software;

    3.    Any special, indirect or consequential loss or damage.
 

Indemnification
 

You hereby indemnify to the fullest extent Piece of Music Ltd from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
 

Severability
 

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
 

Variation of Terms
 

Piece of Music Ltd is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
